A trademark protects the word, symbol, design or combination associated with your company from being replicated by your competitors or other businesses. There are several instances of even multinational business corporations infringing on sucessful brands of other enterprises.

Having invested your money, time and efforts into building a successful business enterprise; the last thing that priority for you should be to protect your brand goodwill from your competitors. Registering your brand with the Trademark Registry gives you legal protection from any conflicts over your brand name.

Registration of a company or business name under the Companies Act, or securing a TIN or PAN does not protect you against others who might commence business using identical or similar names or marks.

If you don’t register your trademark, someone else may do it. Securing your business, or any product or service with a registered trademark protects you by legally preventing anyone else from using similar names and brands.

It also assigns you a permissible right to initiate legal action against anyone who attempts to use similar or conflicting trademarks, which could potentially damage your business goodwill.
